Marioff wins four legal actions for patent infringement

Marioff Corporation Oy announced that the District Court of Düsseldorf in Germany has found in its favour in four separate legal actions for patent infringement against FOGTEC Brandschutz GmbH & Co. KG, a German based company with four first instance decisions dated August 23, 2007. These four decisions, the exact scope of which may be understood from the following link to their original German versions, are presently pending in the appeal instance. They are related to Marioff’s patented advanced high-pressure water mist technology.

In particular, the District Court of Düsseldorf found that FOGTEC Brandschutz GmbH & Co. KG had infringed Marioff’s corresponding patents and ordered that FOGTEC Brandschutz GmbH & Co. KG is liable to “cease and desist” offering and distributing products which are covered by Marioff’s corresponding patents. FOGTEC Brandschutz GmbH & Co. KG was also found to be liable for damages for past and future infringement.

Saarinen also noted that FOGTEC Brandschutz GmbH & Co. KG has filed nullity actions challenging the German counterparts of three of the infringed European patents. “However, based on the facts in those actions, Marioff Corporation Oy is confident that these three European patents will be upheld without limitation by the Federal Patent Court,” said Saarinen.
